Our home is located on the beach in Orange Beach. We are beginning to receive correspondence from multiple attorneys. No oil has washed up yet. Anyone else out there getting these contracts for representation sent to them?

At least in Louisiana, if a lawyer has already contacted someone soliciting their business, they're definitely flirting with violation of the ethics rules.

My home is a tiny one bedroom condo....still nice but not one of those million dollar homes or one of those penthouse condos...haha....that being said, the lawyers are everywhere down there. Kinda strange that they showed up before the oil.

No, they are not. A letter is not verbal or personal contact.

quote:

lawyer shall not solicit professional employment in person, by person to person verbal telephone contact or through others acting at his request or on his behalf from a prospective client with whom the lawyer has no family or prior professional relationship when a significant motive for the lawyer's doing so is the lawyer's pecuniary gain.

Many of the attorney represented different entities during Ivan ie. associations, personal condo owners etc. So they may have had a prior contact with owners in our building. Either way I think it is grossly premature to be considering lawsuits when there has been zero damage yet in our area. Sure some cancellations have happened but is BP really responsible for fear driving cancellations? More so I think the media would be responsible for hyping it up. Now, if oil washes up on our beach then my opinion changes...but until then why file complaints?

Agreed, line up clients early and get a % of the settlement. Could and probably will be extremely lucrative.

My link died, which is probably a good thing, because it is old law.

NEW LINK

However, I think the old and new law are substantially similar regarding unsolicited written communications to prospective clients.

quote:

A lawyer shall not send, or knowingly permit to be sent, on the lawyer’s behalf or on behalf of the lawyer’s firm or partner, an associate, or any other lawyer affiliated with the lawyer or the lawyer’s firm, an unsolicited written communication directly or indirectly to a prospective client for the purpose of obtaining professional employment if: (A) the written communication concerns an action for personal injury or wrongful death or otherwise relates to an accident or disaster involving the person to whom the communication is addressed or a relative of that person, unless the accident or disaster occurred more than thirty days prior to the mailing of the communication;

A letter to property owners for a suit alleging economic damages from an oil spill isn't an action for personal injury or wrongful death or otherwise relates to an accident or disaster involving the person to whom the communication is addressed, IMPLO

Spoke to a friend yesterday whose dad owns a oyster business. Said he has been contacted by 5 different attorneys already.

Why would property owners be able to sue in the first place? I would just chaulk it up to one of the risks of owning beachfront property.
