Wanting to know how to file....
My situation

Married in October of last year.
Wife's dad is claiming her as a dependent since he paid for her school through May of last year.

She has worked since July.

Can we still file Married Jointly, and not claim her expemtions, or will I have to file separately?

TIA

If you let her dad claim her, you are the biggest pussy ever. File married filing joint and tell him she is your deduction now.

+1

And her dad is an a-hole for even thinking of doing such a thing. Instead of helping his newlywed daughter, he is going out of his way to take money from her new family.

With that being said, think about it like this...even if a baby is born on the last day of the year, you can it as a dependent for that year's taxes right? Same holds true here IMO.

We are just trying to work it out for the max return.

He is not trying to screw us, if he gets a good chunk by claiming her then we will get it anyway.

I am just trying to avoid having to pay.

By us filing jointly we don't stand to get much anyway.

Very important detail.

However, it still sounds like he's going to screw you on the deal. The qualifier "good chunk" is what makes me suspicious.

If you don't have much to gain from filing jointly, then take a gamble on the old man.
