And most importantly, when the cops show up, you say "He was gonna kill me and I had to STOP him" then the next words out your mouth should be, "I won't be talking again without my lawyer present."

Don't say shite about killing. The law is about STOPPING them.

I've had my vehicle broken into and was told by the cop that took the police report how to "get away" with killing the perp.

Obviously certain situations have to be there. But he said that if I keep a weapon in my car, that I could easily get away with it.

Basically say you see the perp rummaging through your car, he sees you, and has a grimacing face that has you in fear for your life (especially since you believe he may have found your gun). Bang, shoot him, make sure it does the job (don't leave a witness).

Basically he said you just have to say the right things when questioned. And those are you think he may have found your weapon, or you saw his weapon, and he had a look on his face that made you fear for your life.

You can't just go shoot someone who is burglarizing your vehicle.

This was the advice I received from one of the coolest cops I've ever spoken with. He actually deer hunts in the same small town in Mississippi that I hunt in.

Good info. Thanks for the responses. Pissed off. Someone at work asked why I would kill someone over theft...I reminded him our job isn't the safest out there. If I have to risk harm to do a job to pay for my shite, then they risk harm for stealing my shite.

I'm pretty sure Texas has such a law -- but Louisiana doesn't. In Louisiana our statutes are constructed to allow us to use deadly force to protect people, not property.

If you're in the vehicle, you can use deadly force against someone breaking in.

If you're outside the vehicle, you'll need to be able to articulate why you felt you were in reasonable fear of death or great bodily harm if you use deadly force.

If someone takes something that you have worked hard for, I think it's dumb that they can get off scott-free. Of course, the juice must be worth the squeeze. You can't shoot someone for stealing a pack of gum.

One instance that would be clear to me that was discussed on another forum (1911forum for those interested; i.e. KingRanch) is if you are in a post-hurricane area and someone attempts to steal your generator. That generator is assisting you in sustaining life. If that is snagged, you and your whole family is at risk. I would use deadly force if that situation were to arise. The others I would hope I can decide quickly what to do.

Aside from shooting the perp, could other harm come to them without the fear of prosecution? Such as, baseball bat, tazer, etc.

Don't know about La, but about anything goes in TX to protect your property these days. Been there, done that.

In fact, me and some neighbors had a legal document drawn up where we can use deadly force to protect each other's property in their absence.

One drawback to shooting someone when they're actually inside your car is that the mess really stinks...way worse that any animal I've ever cleaned. You end up having to just tear out the interior. Then there is the sky-high cost of having a biohazard company clean out/cut out your vehicle interior because you don't have the EPA certs to do so....and I guarantee you that folks will be watching to see if you try.

Kinda what I was thinking. As much as I would like to shoot all thieves like the old days, the legal hassle ain't worth it. Civil more so than criminal.

Not in Texas anymore. In my shooting, the dudes were in the street in front of my house (not even on my property). Cops just shrugged and said "oh well." Heck, the turds didn't even have any of my property...they had my neighbor's property. I didn't go to Grand Jury, heck, they didn't even take my gun.

Absolutely nothing happened to the shooter. Totally legal.

And there's no civil issues either because they can't get anything anymore. An attorney will require the perp's family to put up at least $20-30K cash up front before even trying to pursue the case.

Here's a good story about how Texas citizens have more leeway to shoot bad guys than cops do. Also shows how our justifiable homicides are going up (this is a good thing).

Must disagree with you there. Your "Get Insurance" approach is like putting corn out for hogs. They'll just keep coming back and bring their friends until they strip the land to mud and ruin your property. You have to shoot them.

Within a year after Katrina (NOLA thugs relocated to Houston), 10 of 12 homes on my end of the street were burglarized. This only emboldened the south-of-the-border contingent and things got really bad.

We finally had to strike back: killed one, shot two others, and captured a carload of turds at gunpoint.

Problems completely stopped. Now it's totally peaceful. Zero burglaries, not even any unwanted foot traffic. It's been really nice for the last 2 years.
