My friend took the picture. Said he thought he heard it rattle it but didn't actually see the tail.

Absolutely poisonous by that head. If pic is in North America it's a rattle snake.

There are freak accidents, but not getting bitten by a snake is pretty easy really. Never put your hands or feet anyplace you can't see. Follow that rule, and you'll never have an issue.
