Got a legal question on drinking/boating on state lakes.

Ok so me and a few guys are hitting a state lake here in mississippi in a couple months for the weekend. I have a 16 foot aluminum boat with a 40 on it, and Obviously i know operating it while intoxicated is illegal. So here is the question. Lets say i take my boat out that morning. Pull up the motor, tie off and fish and drink all day. When i get ready to head back to the cabin can i legally just use my trolling motor to get me back (it is under a 25, which is the law)

If they can give you a dwi while riding a horse using a trolling motor isn't going to save you...

hell i know a ton of people on the rivee that get 15hp motors and ride all day drinking and get stopped by game warden and dont get a dui. They get the smaller motors just for that. But i was wondering how it would work since i have a 40 but have it up and only using trolling

Haven't hunted since the 70's, but if you have a rifle during bow deer season an are not using it unless needed for say hogs, is that OK?

no but that is not the same. The law as i read it says a motor over 25hp must be being operated to receive a dui.

i mean im obviously not going to just go out there and wave my dick in their face and tell them i read the law and they cant do shite. I honestly have no clue, and was asking if anyone had any real input. I will call and talk to the park rangers and see what they say later on

Correct, if you have a 40hp attached to the boat you will get the ticket.

No where in here does the word operated appear, if there is a means of propulsion of 25hp or greater on board the boat it is defined as watercraft, end of story.
