Parish said as long as they get a key they can't do anything. If they don't get a key they will take it down when they need access. That could be a year from now. They said it's a land owner issue.
I have permission from land owner but the owners SIL refuses to take it down even after land owner said to. Land owner is 80yrs old and doesnt want to deal with SIL.
Now I am waiting for lawyers/sherrif to get the process started to make him take it down.

Land owner of property with gate said years ago he donated land to parish for ROW (working on getting this paperwork) but gave permission to pass just in case. Parish said they don't own and and it's a owner issue. Land owner said get a lawyer to get gate down because he doesn't want to deal with his SIL.

If there is a ROW, what you should do is go out there with bolt cutters and cut in a lock for yourself and anyone else that needs to use it. Then, type up a sign and leave it there saying that that the Parish accessed the property. There's literally nothing he can do about it, he'll run into a dead end with the Parish, and the law is against him there anyway. What's he gonna do, call the Sheriff? Again, the law is against him.

When we needed to gate some property the power company had access to, that's literally what they did. We called them up and asked if we needed to send them a key, and they said don't worry about it when they need access they will just cut a lock in of their own with our permission.

ETA: do you have game cams up, I'd bet money if he hunts he is trespassing on your lease.

I have been keeping that info to myself but he has been caught on many leases over the years on camera and WLF and been charged.

Ok so serious question here, if you break down the gate or just cut the lock every time what's this guy going to do? He is not the landowner, he doesn't have the right do press charges and the old man doesn't want involved.

Whats the worst thing that happens if you simply cut a chain or move that stuff without breaking it?

you cant get away from these types of people Headache is right. Its driving me crazy.

Myself and the other good land owner/hunter (who conveniently owns a land survey company) are meeting with a real estate layer tomorrow morning. Hopefully it is settled and we are granted access. This other land owner/hunter has this family on camera trespassing last season also.

Legally nothing to my knowledge but ill find out tomorrow from the lawyer. These arent the type of people you want to go pissing off like that. I want this done the right way one time and be done.
Im told he held another club's member at gun point while on the club's property. That got him federal charges. Not the type of people to go lick for lick with over some deer. Once i get approval ill give him a few days to get it down and if he doesnt ill have the sheriff's office take it down with me.

They live across the street from the gate and are home all day (if you know what i mean) so by the time i stop cut the lock and drive to my lease, the entire clan of them would be on 4wheelers coming back there to greet me. (just like they did yesterday when i stopped to meet the real land owner. If i beat them to back there im sure my truck would not be whole when i came out

Place one of your own locks on the gate, that way he nor the parish can use it and the parish will tear it down.

Check all around that gate for cameras, anticipate that anytime you are near it, you are being recorded.

Im not doing anything illegal but there are no cameras. Nothing to put a camera on. No trees or post besides fence itself. They live across the street and are home all day everyday so they keep an eye on it for sure.
