I searched, didn't see this talked about.

Lady in BR buys $10K+ in appliances back in February, schedules delivery for mid-March.

Delivery never comes and she learns her order was cancelled the day after she paid and they filed chapter 11.

They are telling her they are only required to give back $2000+ according to the court.

If they went bankrupt I am not sure she can do much-legally.

Eta- I do hear kneecap replacements are quite expensive however.

I wonder if she could have a criminal complaint filed for fraud.

If they knew they were going out of business they shouldn't have taken her money.

most likely shite out of luck. I did some residential work years ago for a guy that waited until I got finished and then declared bankruptcy and didn't have to pay me shite because I was so far down the list on people he owed money to.

This is the biggest reason that bankruptcy is a spirally death. Once a company declares insolvency, most people steer clear of them.

Bankruptcy should never cancel your debts in any form. You should be able to put a lien on anyone or any business that owes you money. A friend of mine had an auto parts place and a guy stiffed him on about 6 or 7k worth of parts one month. He put a lien on the guys house and the guy still wouldn't pay him. He kept the lien updated and when the guy died, the family went to him and wanted him to waive his lien and he told them that he would if they paid his debt. They couldn't do anything with the house until they paid off his debt.

who would you go after in a criminal case though? I would think that the store cashing the check on the day they cancel the orders and declare bankrupt would be criminal for sure but the first one is just unlucky lottery.

I would imagine the manager of the store or the sales rep. If they accepted her check and knew they couldn't deliver, then bankrupted, you could argue there was never an intent to fulfill the purchase.

It's no different than a contractor being paid for a job and running away with no work done.

I would talk with my credit card company. They typically offer certain protections on purchases.

You can do it in an agreement with the person who owes you money (good luck on that) or you can go through court and get an involuntary lien where you attach yourself to property like a mortgage company is a lien holder. They expire every so many years, I'm sure someone can provide better info. I'm not sure if he was able to get it as a mechanic's lien since it was auto parts or just as a creditor.

The difference is that was a business putting a lien on an individual.


Putting a lien on a closed bankrupt business will be more difficult.

First off what asset can you place the lien On? Especially if the building was just being leased and is not owned by the business.

And does bankruptcy give any protection against liens being filed?

Sears Holdings A&E Factory Services will most likely be filing chapter 11. Not only are people that paid for service contracts probably going to be screwed; but anyone that gave 20 plus years and so forth will lose their pensions and retirement--after chaper 11.
