Some people need to remember that bolded statement from the attorney.

I have no idea if the amount of money is a legitimate amount of money for the defamation in this case but a jury thought so. The point is that people can't just run their mouth on social media and think that nothing will ever come from defaming someone because you disagree with their politics or opinion.

Well I may see it differently when someone is losing work because of some a-hole couple dogging her on Facebook.

You don't know how.muvh business she may have lost over it. That spans until she quits working. Not just a year or 2

I'll go ahead and assume the couple was not pleased with the photographer's services and lashed out on social media, then she sued them.

Sounds like the couples wedding photographer sucked and they took it to social media.

I only know what is in the article. I just happened to read this article shortly after reading cocoloco's thread. He mentioned someone's job for no real reason. In some case that goes too far and becomes defamation.

Was the award too much? I don't know. How much business and future business did this photographer lose because of the defendants in the suite?

It appears they signed a contract stating the purchase of items, but didn't want to and used social media to call her a scammer.


Idiots.



A Dallas County jury deliberated for two hours Monday and saw evidence in court that "affirmed that Ms. Polito followed the terms of the contract signed by the couple and even sought to further explain the contract and satisfy their demands," the release said.

The Moldovans were found liable for disparagement, defamation, and civil conspiracy. They must now pay Polito $1.08 million in damages.

I am of two minds here.

1. You sign the contract, you are responsible.

2. Hiding onerous stipulations deep in a contract is pretty unfair. Let's not forget the local contractor who screwed all of those folks with his contracts after the flood.

Sounds to me like they signed up for all of the crap in the contract, decided after the fact that they didn't want it, then took to Facebook to smear the photographer after she wouldn't give them their money back.

If they couldn't afford a $125 photo cover, which is in fact what this whole thing is over, then I seriously doubt they will be able to fork over $1.08 million to this this woman's hobby photography service.
