OT Lawyers,

Tell me about filing suit in a tribal court. Any pitfalls I should be aware of?

And before you ask, yes, this will be the extent of my due diligence. Deal with it.

I'm not a lawyer, but I think you have to sit with the tribal leaders. Bring a peace pipe and fire water. If the ghost of Ata'halne appears, you can go forward with your suit.

Again, I'm not lawyer but I'm pretty sure that's how it works.

Disclaimer: I'm not an attorney. But have worked a lot in them, mostly in WC.

Most have adopted the rules of the U.S. Court, but your case will be heard before a tribal judge. He is appointed by the tribe. Jurisdiction is solely his at the trial level. Good news is that on appeal, jurisdiction goes back to Appellate Courts.

Oh, and obligatory they frown upon white eyes who argue case with forked tongue.

As long as its not my casino you're after, have fun.

If you're going after a casino, I hope you can afford better lawyers, and are able to slide more money under the table than they can.

They love their goddamn lobbyists too.

On the WC side, I laughed the first time I attended. Old judge doesn't follow any of the rules. Midway through trial judge says he's ready to rule. Defense says wait, you can't do that, we haven't even started putting on our case. He says he don't care, knows how he's gonna rule. She says, but you can't. He says, "Missy, watch me". Rules. She's humiliated that he calls her missy.

It's appealed, and we settle before it goes up. It was hilarious.
