Early said the investigation is ongoing and they anticipate there will be a murder charge. The charges filed against Colon-Ortiz, were “the charges we determined were the best to go forward at the time.”

He does not have a criminal record that authorities know of at this time, Early said. Authorities said they do not know for sure that he is a U.S. citizen.

“We don’t know that, at this point,” Early said when asked if Colon-Ortiz is a U.S. citizen. “The information we have, I can’t make a statement in regards to that at this point.”

Public records indicate Colon-Ortiz is from Puerto Rico, which would make him an American citizen.

That perplexed me as well. Clearly she's been murdered and he's been arrested for it but charged with the lesser offenses. Not sure the legal thinking behind that but there must be some reasoning. Paging all OT DA's.

I've read a few different stories and no one seems to comment. I'm guessing he's a citizen, but I'm also very skeptical.

I read this as a 27 year old case (cold case) of a jogger who was murdered. Then I saw the picture and I thought, that doesn't look like a photo from 1990!

I guess I should have said "suspect captured in murder case of 27 year old jogger." It's the Monday morning after Easter weekend, I'm not at my best.

They tied him to the case via DNA. Most likely reason for the current charges are that they can link him to the scene via DNA but not to the actual murder YET. They want him in custody so he doesn't take off and so that they can question him. Homicide detectives always want a confession. So they will try for that first.

I don't recall the legalities of an in-custody interrogation and the requirement for the presence of counsel, in that jurisdiction it might even vary although it is primarily a universal constitutional requirement, but questioning him about something with which he isn't charged yet may or may not trigger the automatic right to counsel. It has been a while since I reviewed that issue. Someone more current might want to chime in on that.
