I read that the timeframe is 30 days to notify a previous tenant on the status of their deposit. I waited six weeks with no notification and then emailed the office for an update. They told me they'd have to check with upper management and they'd get back with me. A week goes by with no word from them so emailed them again the other day to see what the deal is. It has now been two days and they have yet to respond to my email. They have always responded same day in the past.

So basically, what is my next reasonable course of action? I hate having to chase money around and they are on my last nerve at this point.

This is not legal advice but maybe read your lease?

I've gotten my deposit back pretty much everytime I've followed the instructions of the lease and not had some other kind of dispute going on.

I've read the lease. Believe it or not, the lease doesn't give advice on how to pursue the leasor if they don't give you your deposit back in 30 days.

It's a company, yeah? fricking wreck their world until you annoy the shite out of them.

I understand patience and civility if you were renting from some nice old couple, but not from an entity that does this sort of thing every day.

Oh yeah, it's a sizable company. I had a really good relationship with the folks running my complex so I want to give them the benefit of the doubt for now but we're going on 2 months and they can't seem to provide me with any information whatsoever, which is rather odd to me.

The Lessee’s Deposit Act requires the landlord to return deposits within one month after the end of the lease, provided the tenant fulfilled the lease obligations and left a forwarding address.

If any part of the deposit is retained, the landlord must send the tenant an itemized list of deductions and any remaining balance within one month. If the landlord fails to return the deposit or to send the itemized list within one month, the tenant may sue in Small Claims Court to recover the deposit.

If the landlord fails to account for the deposit within thirty (30) days of a tenant’s written request for a refund, then the law allows the tenant to recover actual damages (amount of damages made) or $200.00—whichever is greater. The judge may also award court costs and attorney fees to the person who wins the suit. The law does not permit the tenant to give up, or waive, this right in a lease.

Southgate? I had to threaten a lawsuit for them to pay me. Within an hour of me doing that, they cut a check

Eta: It is 30 days

They will probably get back to you in the next day or two. Phones, tours, and emails have been insane over the last 2 weeks. We keep having to put our phones on service just to get anything done.

Theres your problem . If they holding up a sizeable amount of money then its time not to be so nice. Had you withheld money from them the collection company would already be calling you!

If you really wanted to be a pain in the arse you could file a police report.

I would bring them to small claims court (or threaten to by certified mail). If they don't respond, make a claim.
