Sort of a spinoff, should the allowable BAC be higher if driving slower speeds?

When a boat motor or jet ski has a minor impairment it will go into "limp mode" allowing it to safely return you to the dock or aid without being able to do much harm to the engine.



So why not say .08 is a DWI if the vehicle is traveling over 35mph or on a major hwy? And .08-.15 is not an offense if under 35 mph and after 10pm


Should penalties be staggered based on the level of harm one could do?

I say if you have a self-driving car you should be able to have a fully stocked bar in the glove compartment.

Areas where a speed of 35 is acceptable are often areas of increased likelihood of pedestrians. For this reason, I'm out.

My personal opinion is that older drunks(40+) under .13 bac who drive speed limit or under are much safer on the roads than texting teens or testosterone-laden plant workers in the AP on way to or from work in the AP who drive 80mph on roads like 931,621,431.

I am quite certain I'm safer than them if drinking and driving... up to a pint of booze or a 12 pack.

Because people that don't show up well in the dark definitely don't go out walking after 10pm

good lord...now imagine a bunch of people driving with a legal BAC of.15 at the same time...what could possibly go wrong

I wish like HELL the laws regarding manslaughter and hitting pedestrians would consider comparative negligence when the pedestrian is walking along a road at night.

One night I was driving down Seigen and had 6! People, at different points, run across the road in front of me.

Not at a stoplight but at any old point in the damn 6 lane plus a median fricking highway.

One old black lady was just moseying across like it was a god damn sidewalk. I honked at her and she started mouthing off at me.

It's absolutely absurd. I'm surprised more people aren't hit

It's a good one that stirs up some shite. Perfect Friday material.

The stigma of drinking and driving is WAY overplayed and unfairly attached.

The DWI laws are fricking absurd.

I've said before.

Bump the BAC back up to .1 for drivers 21+

First offense DWI is same as it is now UNLESS it's associated with excessive speeding 20mph posted speed limit or an at-fault accident(I'm not talking about bullshite charges like following too close, headlights/brake lights, improper lane usage). That should make mandatory 30 days in jail. The penalty tier for over .16 BAC should make penalties SAME as second offense.

Second offense is a felony and 6 months mandatory prison. No exceptions no suspensions.

That would make a big difference. If You start costing people their freedom and livelihood, shite would improve. But nobody wants to compromise and accept that some people can drive safely while enjoying a good buzz.

I say we educate and train the public on how to handle driving drunk instead of blaming all these issues on drunk's driving...

Yikes. I can't even say that. You have to be trolling. I imagine the ~20 times in my life I've hit .2+ I don't remember much.
