WASHINGTON (AP) — A federal appeals court ruled Tuesday that the government can't refuse to register trademarks that might be considered disparaging or offensive, a decision that could bolster the Washington Redskins in their legal fight over the team name.

The ruling from the U.S. Court of Appeals for the Federal Circuit sided with an Asian-American rock band called The Slants, which has spent years trying to register the name. The U.S. Patent and Trademark Office had refused to give it legal protection on the ground that it disparages Asians.

Writing for a nine-judge majority, Judge Kimberly Moore said the First Amendment protects "even hurtful speech that harms members of oft-stigmatized communities." She said a federal law barring offensive trademarks is unconstitutional.

"Whatever our personal feelings about the mark at issue here, or other disparaging marks, the First Amendment forbids government regulators to deny registration because they find the speech likely to offend others," Moore said.

Hold off on the rejoicing-; this will most certainly wind up on the Supreme Court's docket...

Nice.

But that's actually my favorite part - the government trying to tell Asians that they can't use a name because it's offensive to Asians.

That this isn't readily obvious to 100% of Americans is really sort of sad.

My punk rock band's name is "The frickhead Obamas" and I'd like to get our name and brand copyrighted, so, I'm glad to hear about this case.

No shite, and they will make up whatever they want.

Everybody already knows how 4 will vote because they are incapable of independent thought on the merits of a particular case.

Yeah, the Obamacare rulings blew me away. We'll see, but the correct interpretation seems to be that you don't have a right not to be offended.

This judge will now be audited by Obama's IRS Stormtroopers.

Patent Office knew they would lose this. IIRC this bit of case law has been established for a long time.

An African American and a transgendered Filipino walk hand-in-hand.

What race is the Filipino's father?

I knew you weren't human.

Well, I didn't think I had a constitutional right to healthcare, but surprise!! I do !!

Anybody who has even a remotely conservative bone in their body should vote for whoever the hell is running against Hillary Clinton. Let the liberals get one more vote on the Supreme Court and we are fricked - for good.
