Signs on gates that abrogate responsibility?

We've all seen them.



What if I put a sign on the front of my car that said "Owner/Driver is not responsible for damage to gate"?

Really though, just whom are they claiming is responsible if a piece of equipment they own on their property damages my vehicle?

They can put all the signs they want but if an accident happens on their property then they can be held responsible.

The driver of the vehicle who took the risk after being informed about said risk.

Not sure the sign means shite. Just a scare tactic.

If their gate malfunctions and damages a car that you were lawfully operating, I'm fairly certain they are responsible

I think it's just a scare tactic to keep people from rushing through the gate. If the gate malfunctions due to lack of maintenance or negligence then the property owner is probably still liable. I guess it depends on the scenario.

In this case it's much more advisable to move the small carcass into your home and stage the scene as a B&E.

I would most definitely think they are responsible for the load they are hauling, especially if it isn't secured properly.

As someone who has had to deal with a lot of this I can tell you that once the rock hit the ground it technically becomes a road hazard and they are no longer liable for the damage. It is stupid, but that's how they avoid paying for windshields.

I've always wondered just how far they can push that - if they are hauling 10-ton boulders and one falls off on interstate, do they still get to claim "road hazard?"
