Rouzan homes must be torn down

WBRZ
BATON ROUGE – Up to eight high-end homes in the Rouzan development should be torn down after a judge ruled in favor of landowners who sued developer Tommy Spinosa for building on property Spinosa did not own.
The WBRZ Investigative Unit first reported on the issue in April. Click HERE to read the original story.
Then, WBRZ found five homes were in jeopardy of being torn down due to the possible servitude violation. An attorney said Tuesday though, it could be between five and eight that may have been built on property that now must be “restored to its original condition” for the rightful landowners. The houses in question are valued around $400,000 each.

I mean, that's certainly not a shack, but I would hesitate to call that "high end"

Spinosa = Dick
Is the surveyor liable on this?

a monetary settlement could mean the houses won't get torn down but an attorney said it is up to the landowners to agree to a specific settlement
I think this is probably how this will ultimately be resolved.

I think these two families HATE Spinosa. He tried to get them kicked off their land, or to sell below market. They strike me as the types to want to really F over Spinosa at all costs.

And who can blame them? The dick stole property and built on it. Then, told them they should just deal with it. I would sell the property to Spinosa, but market value just went through the roof.

Agreed.

Wonder if title insurance will kick in on this deal? How anyone can let that clown build anything for them is beyond me.

My good friend is the "land owner". They have fought the good fight.

I'll always remember back in 2007-2008 when I was gaining in political activism at LSU and this guy was around. Wanted to build that traditional-neighborhood development on Perkins by Lee and was going to F up all sorts of traffic.
They guy running for council to represent the area had basically one issue, and that was that he would oppose the development.
So, he wins and the council goes to vote, and he votes "Yes". Then, he promptly resigned.
Turns out that Rouzan/Spinoza were secretly funding his campaign the entire time.

This was beaten to death in the other thread from a month or so ago. Nothing was stolen. It was Spinosa's property. The plaintiff's just had a servitude across his property. It appears it was something they didn't use. He tried to relocate it. In doing so, he made it 20', not the 30' they had previously. Pretty dumb move on Spinosa's part, but it's not like he took someone's property.

is this acreage or lots in a subdivision?

I am fairly certain the landowners could just claim ownership of the homes and not have to pay anything under Louisiana law since the houses were built on land they own without their consent. So, they are probably motivated by something other than money or a desire to screw the developer here, e.g. they actually don't want development on the land.
What a bonehead move by the developer.
ETA - looks like the kicker will be the obligation to restore the property "to its original condition"...$$$$$$$

I feel for the people who live in those houses because Spinosa will probably just file bankruptcy on this business and never pay them back fully.

Wondering the same thing. Seems as if it would from what little I know about it.

Bottom line-it was unethical and unprofessional and it has created victims who will have their lives turned upside down.
