So, they are replacing some culverts under the road next to my house. The jackass hit a gas line which forced the gas company to come dig in my yard. There is also going to be large spots of dead grass from where they dumped dirt on my grass. Is someone obligated to bring my yard back to its original condition? Would it be the city or the construction company? Thanks.

Isn't the servitude considered 10'+ from the curb?

Here in FL, they would be responsible for fixing their mess.

However, if it's on the easement, that may change things. You don't own the easement even if you beautify it.

Generally but not always the contractor is responsible for putting it back like it was pre con.

I don't think they have an obligation to YOU if the work is within the easement/servitude. In my limited experience, contractors are often required to fix it per their contract with the city/state. With that said, Baton Rouge water workers drove a mini excavator across my yard and didn't give a shite about the damage they did b/c it was within my servitude.

Pics of mess? May be a good idea to take some if you're planning to go legal.

A good engineer/inspector will see that your yard gets fixed, most likely with sod. If not take your problems to the mayor or city council.
Usually there are all kinds of people wanting all kinds of stupid favors, but that is a legit gripe. They'll fix it.

You think the OP wants a bunch of posters on here to go stand outside his mansion and harass the constant stream of OT 8s arriving and leaving?

Obligated? Maybe not.

Should they? Absolutely.

Raise hell whether it be through the legal system or media.

Find out if an engineer is handling the project. If so complain to him/her, they get paid to resolve issues like this. They are responsible to approve pay request from the contractor, so the contractor is usually happy to take care of minor issues like this. Keep in mind it make take a months and months to get your yard back to what it was.

Jankothy needs to get out there and get his hands dirty. Landscaping isn't beneath him. He's one good market crash from having to dig ditches anyway. It'll be good practice.

Call the contractor and ask for the right person to speak with. Meaning not the person answering phones or someone's secretary. Calmly and professionally explain the issue, don't blame anyone or be a dick and then ask them to fix it. If they hesitate, be honest and say that you are going to keep pushing the issue and it is easier for both of you if you don't have to go through the City. If he refuses after you were polite, then document the name, time and date and call your Councilman to bitch. I have found the vast majority of people would rather work with you than deal with backlash once you elevate the complaint. I never threaten them but I am very direct about where I am taking the complaint next and that I won't be letting it go.

OP should know the OT laws.

quote:

OT 14:40.2 Any OT 7 (IRL 9-10) seen leaving, or walking away from another's house, domicile, vehicle or dwelling is considered "fair game". This also counts if the female is 25 feet from said dwelling.

The ones arriving are off limits, the ones leaving he shouldn't care about anyways.
