re: Pros and Cons of refusing the breathalyzer on a DUI stop
Got arrested for suspicion of DUI in 2007 in BR. Passed field sobriety test. Refused to blow and requested a blood test. I was never given one. Spent 20 hours in jail and was held for 5 hours after my bond was paid.

Prosecution tried to wear me down in court by continuously delaying...for 2 years. Ended up taking a plea deal and worked 16 hours community service, after 7 court dates and $2500 paid to lawyer.

Was not blowing worth all of that?

I spent 53 hours in jail.

By the time I'm done I'll pretty damn close to $10k and a lot of fricking headache along the way.

Also, this thread here completely displays my discontent with DUI laws. They aren't applied the same across the state by any means. Depending on the jurisdiction, you have tons of different degrees of punishments.

That's the nature of most criminal laws.

What this thread really displays is how complicated and maddening DUI law is.

I wouldn't call that lucky, yeah his punishment was easy, but spending almost 2 years waiting that shite out. You just want to do your due and move the frick on, it sucks having shite preventing you from doing so.

You got lucky. I spent about $5,000 in direct costs, lost my job, and spent 15k out of pocket on court ordered DUI classes which were for 6 hours a week for over 36 weeks. And I wasn't even driving, but had the keys in my possession.

You have no idea how many people talk to the cop like friends. They'll say, "To be honest, I've had a drink or two...but I'm not drunk."

If you haven't drank at all, just comply and you will be on your way. If you are drunk, then you deserve what you are about to get.
