OT Lawyers - Can the baby momma of Sterling sue?

Does the Baby Momma / underage rape victim of Alton Sterling have standing to sue the BRPD for his death? I know anyone can sue anyone else for anything these days but does she stand a shot at winning if they go to trial? What is their legal relationship? Does sharing a child entitle you to make a claim?
How about the Aunt that raised him?
His illegitimate child?
I know there are people running around with dollar signs in their eyes and I am wondering who is going to get my tax dollars.

Could the police officers sue the sterling family for putting them through this shite? I don't really care if they win or not but make them spend some of that gofundme money on defense
Baby Mama has no right of action, but she could bring action on behalf of Sterling's kid(s). No one else can sue.....even if there is a recovery on behalf of the kids, Judges have to power to approve and Order any funds going to the minor gets set up in a way that no one can spend it. For example, Judge could Order funds deposited into bank not to be withdrawn absent a Court Order. Bank gets copy of Order and sets account up this way. Another option, and one I prefer, is for Judge to set funds up in annuity that pays out a little at a time when children reaches age of majority.

I'm not an attorney, but how would you go about suing the police? I was under the impression that you could not sue your state or any state agency (police department)? Do you sue the officer personally?

Yes. There is a federal law called 28 usc 1983 that lets you sue.

Baby mama has just hit the jackpot. She probably didn't get much child support and this will be a payday. She has 2 lawyers already.

The state gets sued hundreds of times a year.

Even if you prevail in a 1983 action you still may not get your money unless the state has allocated enough to that fund

This is Louisiana, if you get a settlement it doesn't mean you are getting paid.
The New Orleans fire dept just got the hundred plus million dollars they were owed, it dated back to 1974. Some people were upset because they got to jump to the front of the line.
