Id call my insurance co of the cost of the fence were greater than my deductible. If not, id go get a chainsaw, stop being a girl, cut the tree up, and fix the fence.
I didn't realize asking for advice was being a girl
I forgot this was the OT and you'd probably be out there as we speak with a dull hatchet and a headlamp because a chainsaw would be too easy.

I like this idea, great way to mend fences.

File an insurance claim. That's what you pay homeowners insurance for.

Now you're learning!

But seriously, its going to fall on your insurance. Pun intended.

In fact, they're usually excluded. By name.

Burn the tree and your house
Collect money from insurance
Sue your neighbor
Bribe him with the winnings
???
Profit.

I had a tree at a rental property uprooted by a tornado last year and totaled the house next door. State Farm paid to get the tree off the fence so it could be repaired and paid for the fence. I had other damages to the house so deductible wasn't an issue. My tree guy just cut the to the property line on the other side of the fence. Neighbor had to cut up the tree on his side of the property line.
There is a 2 bedroom house underneath what is left of the tree after cutting what was on my property.

What would you guys say if the neighbors tree was dead? Then it's neglect is present, right?
Meh. From what I understand, a reasonable person would have to be able to conclude it's a danger and all of that.
Good luck proving that shite, especially over a damn deductible, the lawyers would make more money off the case than anyone else.

How would the OT handle it?
Loot Home Depot for supplies to fix the fence.
And of course, PIIHB.
