Louisiana fisherman are losing fishing access in marshes across Louisiana due to land owners who are stopping anglers from accessing tidal waters that go through their property. Land ownership should constitute ownership of land and not the water that flows in and out and over it. We want to have the "if it floats it boats" policy enacted in the State of Louisiana. This policy is in line with every other state in the United States.

I know the guy who started this let's get this going.

this is the umpteenth petition on this which will go nowhere. the legislators don't give two shits about a petition.

unless and until the legislature passes a bill and the governor signs it which changes the law, its all just talk. people need to actually call their state reps and state senators and the governor's office regularly and make the lack of access issue such a pain in the arse they will fix it just to make the harassment go away.

of course, 2017 is a fiscal session, not a regular session, so nothing will happen this year.

it's so f'd up.

I have a camp in a dead in canal and have it gated off. There's no reason for any boats to be back there.

Do you own the land and who dug the canal?

I don't gives shite about anyone's fishing rights. If you own the property it's yours. With all the marshes being destroyed I wouldn't want any boats speeding through my land

I lease the land from a private owner.

I did not personally dig the canal myself

No well head. It's a one way in one way out canal.

Sounds like the whining of a bunch of poors with no understanding of what's actually going on.

Assume you own private property that has a private pond completely cut off from outside access. Then, an oil company digs a ditch to access a well site on your property. Just because a boat can get in there now does not open the private property to the public.

Thus, people started putting up gates to protect their private property.

I'm not a big fan of it, but as a guy with oilfield and title experience, it's a fairly simple concept to wrap your mind around.

Can someone explain exactly what this includes?

My property in on a waterway.

Would a change in the current law allow someone to walk or drive across my property without my permission in order for them to get to the waterway?

ETA: Never mind. I just re-read the quote and see where it only includes "tidal waters." The water bordering my property is not tidal.

Negative. They mean via boat only.

Most of the leases in South Louisiana pre-date the current owners by many years. Don't be crying when we come set off charges around your stuff to explore by 3D seismic survey.

Have them fill it back in. It's tidal water. COE is in charge of it, so it's a public waterway

My understanding of it would be that you would own the land under the water, but not the water itself, if that makes sense.

So someone walking or driving on your land would still be trespassing, but someone boating in and out on the water would be in the clear.

Its all about the money! They want their so called "land" (marsh) to be protected and built back up but do not want the public to have access. But yet, they are getting it done with tax payer money but the taxpayers have no access to it.
