Legislator wants you for MORE jury duty...

on small claims. So get ready to be much more likely to lose up to a weeks work for $34.00 a day....

"I'm a trial judge and I just cannot understand how anybody can disconnect that if this bill passes that we are not going to spend a more inordinate amount of time trying to handle the case load that we presently have," testified District Court Judge Bob Morrison.

This bill is the most ridiculous bill going right now and is at the behest of the multi billion dollar insurance industry and large corporations. these guys want to force low ball settlements on cases that would cost more to bring to trial than they are worth. The little man loses if this bill passes.

No. You shouldn't be wasting people's time to serve 3-4 days twiddling their thumbs in a jury holding room cause they might get called to serve on a small claim.

That's overwhelmingly obvious.

$34 a day? Our cheapskate broke county here in Alabama pays you $10 a day, plus a nickel per mile roundtrip. I served monday and yesterday, and got a check for a whopping grand total of $22.30. Plus I had to miss work at a month and quarter end, and am way behind this week and will have to work 10-12 hours the next 3 days to catch up. Didn't sit on a single jury. Got called into 3 different jury pools. Only one of those were actually selected. One of them was resolved (criminal case) right before jury selection began. 52 people sitting in the court room ready for jury selection, and after delaying for 30 minutes the judge finally came back and said we had to go back to the jury pool room. Another didn't make it to selection because apparently what insurance provider you have for your car insurance might sway your opinion. Judge asked how many of the prospective jurors had a certain car insurance company, and over half of the 42 prospective jurors raised their hand. The judge and attorneys went to his chambers for 20 minutes and then the judge's assistant came back out and sent us back to the jury pool room. Biggest waste of time. You'd think they'd have their shite together and just be ready to roll by the time a trial comes around 4 years after the fact.

Which in turn will ultimately lower the overall auto insurance rates in Louisiana. Want to know why Louisiana has one of the highest auto insurance rates in the US? This and the Gordon McKernans of the world are one of the big reasons. People in Louisiana (specifically major urban areas) are sue happy. By paying out these ridiculously high "settlements" the costs are ultimately passed on to you, the insured. Look at the other states with lower thresholds and compare their rates. It's the "little man's" responsibility to be properly covered. If you're underinsured, it's not the company's fault.

What's insane is you have LABI sponsoring this bill like it is a good thing to have LOTS of jury trials.

Typical Louisiana politics, we go from maybe being the dumbest State with the highest jury threshold to the dumbest State with the lowest jury threshold. We don't have the sense to get out of our home way.

Why for once can't we just do something normal and simple like copy what smarter people do. Find a State with smarter people and just copy what they do.

36 states have 0 jury threshold...

i barely tapped another car last May in Orleans Parish and the lady and her passenger both got 10k in medical expenses despite there being 0 damage to her car (they got 1k for that)

and people wonder why we have the highest auto insurance rates in the nation. it's morris bart's fault

kudos to my legislator Mr. Garofalo for sponsoring this bill

Every State has their own Morris Barts so it's obviously not that simple, unfortunately.

I don't think that more jury trials is the answer though. More cow bell maybe, but not more jury trials.

Louisiana needs a "losers pay" law.

That will stop the frivolous BS lawsuits.
