Lawyers not disclosing previous damage on new car purchase.

On a new purchase if dealer does not disclose prior paint work what are your options. The car is 2 years 11 months old. The 3/36 is over by about 5k the part that is is in questions is starting to fish eye and about to start pealing. There is also trash all in the paint in this small area. So I know it isn't factory paint. I found the damage yesterday while washing my car. I then called the repair shop that just replaced my hood due to hail damage thinking it might be hail related he stated it had been repainted because of the fish eyes and trash all in the paint. I plan on calling corporate tomorrow to see my next step. All I really want is the part fixed.

My wife's cousin is a mechanic for a Chevy dealer and he told us that after a severe hail storm one year, they cut the roof off of a optioned out Camaro, and welded on a new one, then repainted. They put it back out on the lot and sold it as new. That is messed up!

yes brand new it has 42000 miles on it out of the 3/36 but not disclosing prior body work should be covered I would think

sometimes cars are damaged in shipping and the dealer doesn't even know

so it's not new and it's used? Then you bought it "as is"?

And you can prove the dealership knew about it? And you can prove they had any duty to tell you?

Correct. Cars are moved by train from manufacturers and sometimes get damaged in the process. When this happens and they get to dealers still damaged , the dealer will fix and sell as new .

You can't recover, realistically.

You've had it too long.

You may be able to get it fixed under warranty, if your 3/36 includes that.

Make/model?

ETA: My bad, you're over on the mileage. Probably SOL.
