In the eyes of the law, who is the mother in this situation

My question is about the women who physically gave birth to the child. Obviously the donor and the owner of the egg would be a match as far as DNA is concerned, but I can't seem to wrap my head around what the woman giving birth would be considered. Does birthing the child make you its mother or does being a DNA match make you its mother. Maybe both are correct?

states that allow surrogacy have detailed provisions in the law for this.

That situation is really no different than if a heterosexual couple put the fertilized eggs in a random surrogate. The one that produced the eggs is the mother.

It's a trick question. The doctor can't operate on the son because the doctor is the mother.

I was under the impression that surrogate mothers don't maintain custody of the child after birth. Does that law still apply with they both raise the child together?

this isn't an issue of "custody." a surrogate donor is not the legal mother of the child. the child's mother is the woman who gives birth to the child. i imagine the other "mother" would need to adopt the child. however, in states like LA, we will need to revise our law to deal with this situation as we currently only recognize one legal mother and one legal father at a time.
