I get that...I just think first degree murder is excessive

I'm not claiming an improper application of law. I'm saying the law sucks because it has zero nuance

USUALLY

I don't know about you, but if someone breaks into my house while I'm at home...I'm not taking a chance that USUALLY burglars aren't trying to kill me. Better to be judged by 12 than carried by 6

It's there to discourage people from participating in felonious activities.

This is so funny, his grandson breaking the law, guess it would've been fair if they stole everything....

I know that, I just think it's stupid because I don't think it discourages people but even if it did, it just leads to someone getting an excessive sentence

21 year olds don't think about consequences. they don't know about the law...it basically in too many cases IMO creates a "one strike and you're out" law

If her record is otherwise fairly clean, then I would think she's got a shot to take a plea deal for a lesser charge than 1st degree

But the easy solution is to not be a POS committing felonies and try to rob people.

most 21 year olds also manage to make it to 22 without being a getaway driver for an armed robbery.

If you're 21 and you aren't thinking of the consequences of your actions when committing a home invasion, armed robbery, or any sort of violent felony, then there is no hope for you.

as a matter of law she's committed first degree murder. as a matter of common sense...no. so the starting position is first degree murder and she pleas down to what? 20 years, 15 for good behavior?

the morons who went into that house didn't have a gun to their head...well, you know what I mean

I don't know Texas law but in many states it would be considered aggravated burglary.

I don't think so, I think this is a great way to learn about consequences...10 years of prison (and prisons are fricked up) would probably teach you

but first degree murder? i'm not crying a river over here, I just think this law is stupid.

she is a criminal and needs to go to jail...but first degree murder? come on, that's ridiculous.

yup and not because there's a law that charges you with first degree murder for being the getaway driver for an armed robbery

she deserves to go to the pokey and has committed a serious crime...but first degree murder? that's preposterous, just my opinion.

that's capital murder
