Well for one it eliminates the stiffer penalties that come with higher bac numbers.

Well if u can get charged with rape because a chick is too drunk to concent they pretty much have to admit these people were also too drunk to concent

Sounds like they admit they were drunk, but not over the legal limit. If they get the charges tossed and it pisses the MADD Gestapo off, even better.

I feel this is where the word "too" comes in. Not only are you drunk, which by definition means you are intoxicated to the point where you are impaired both mentally and physically, but you are admitting to the fact that you were too drunk to understand that a bac test could cause consequences should you fail.

I'm sorry but I have no respect for those who knowingly drink to the point of being "too drunk" and put other drivers lives in danger.
