A former Habersham County Sheriff's Office deputy and special agent of the former Mountain Judicial Circuit Narcotics Criminal Investigation and Suppression team has been indicted by a federal grand jury following accusations she falsely obtained in May 2014 a “no-knock” search warrant, which resulted in critical injury to a Wisconsin toddler upon its execution at a Cornelia residence.

Nikki Autry, 29, of Clarkesville, has been indicted by a federal grand jury on charges of providing false information in a search warrant affidavit and providing the same false information to obtain an arrest warrant. Providing false evidence to a judge to obtain a warrant is a federal civil rights violation.

“Our criminal justice system depends upon our police officers’ sworn duty to present facts truthfully and accurately – there is no arrest that is worth selling out the integrity of our law enforcement officers,” said Acting U.S. Attorney John Horn in a press release issued Wednesday. “In this case, Autry is charged with making false statements to a judge in order to obtain search and arrest warrants. Without her false statements, there was no probable cause to search the premises for drugs or to make the arrest. And in this case, the consequences of the unlawful search were tragic.”

Bounkham P. Phonesavanh, referred to in the media as “Baby Bou Bou,” was 19 months old when he suffered lacerations to his face and torso after a flash-bang device detonated in his crib

This sure as hell won't hurt the civil suit against the city, which is ongoing I believe.

Good.

This is the thing that liberals and sjw crowd will never acknowledge. When the cops are in the wrong the conservatives identify and agree with them. That kind of professional courtesy does not go both ways these days as in the Michael Brown case where the uber liberal DOJ declined to prosecute and flat out disproved their false narrative.

Eh, there were (and probably still are) posters on here that agreed with the initial state grand jury no-billing of the cops involved in this incident. I can think of three right off the bat that said it was the parents' fault for the toddler being in the presence of a drug dealer. Some will just believe the police no matter what.

She lied about there being an informant that purchased drugs there. That purchase was used in her application for a no knock warrant. In other words, the raid was built on a fictional purchase. If that's the case she can't go away long enough.

From the FBI website

quote:

Eventually, a brand new NCIS informant and two of his associates – his wife and a roommate – went to a residence located in Cornelia, Georgia. The informant’s roommate, who was not officially working with NCIS, approached the residence and allegedly purchased a small quantity of methamphetamine from an individual unknown to him who was standing outside the residence. There was no police surveillance to verify the purchase. Shortly afterwards, Autry presented an affidavit to a Habersham County magistrate judge falsely swearing that the NCIS informant made the purchase and that the NCIS informant was “a true and reliable informant who has provided information in the past that has led to criminal charges on individuals selling narcotics in Habersham County.”

The federal indictment alleges that Autry knew the NCIS informant had not purchased any methamphetamine from anyone at the residence and the NCIS informant had not proven himself to be reliable in the past. Additionally, the indictment alleges that Autry had not confirmed that there was heavy traffic in and out of the residence.  Based on this false information, the magistrate judge issued a “no-knock” search warrant for the residence and an arrest warrant for W. T., who allegedly sold the methamphetamine.  The warrant obtained by Autry was executed approximately two hours later, during the early morning hours of May 28, 2014.

It's always been a fine line between serving and protecting and flashbanging toddlers. Story as old as time.

Checking in.

As unfortunate and regrettable as this incident was, it would be far more unfortunate to have our streets flooded with poisonous drugs. Also we don't have the full story on which side actually threw the grenade, why not wait til all the facts come in before making a judgement?

Who thinks this result would have come if a toddler wasn't injured during the raid?

Honestly, it sounds like she is taking the fall for someone else.

There's more to this story than we may never know...

nice.

Now punch the judge in the nuts for not just saying, "can't you go in the morning & knock?"
