Ending a month to month verbal rental agreement

How many days notice do I have to give to my landlord? The guy seems to think because our signed lease ended in july 2013, and that we have verbally agreed to a month to month that somehow I need to stay until the end of july 2014.

I'v never had a problem with him. He's not invasive or has ever gotten into any altercation with me. But I told him on june 15th (have it documented) that my last day would be june 30th. He came back with, no we verbally agreed to july 31st. I have no recollection of this, and have never signed anything after our lease ended on july 31st 2013. I'd love to get my deposit back and NOT have to pay for a month of rent that I'm not going to be living here

I would say one month is sufficient

was the lease set to renew at terms or go month to month?

Generally though 30 days notice is sufficient after the lease terms end.

I'm really wondering what LOUISIANA law states for renters during a month to month and what is the minimum amount days notice that must be given. IF worse comes to worse I'll shell out a full months rent though

You told him today that you were moving out at the end of June? 10 days Is kind of a dick move, but nothing he can say or do without a signed lease. At least you taught him never to use a verbal lease again.

My apartment rent was gonna go up 300/month if I went month to month and they still required 60 day notice of termination

There are laws that govern this situation to keep lessees & lessors on a level playing field. I assume it would be through the magistrate court. You can call a lawyer, but you may get a bill.

On the 15th he straight up asked , "when will be your last day" . I said end of June. So yeah i notified him OFFICIALLY by a letter today but I also have it saved in text from my answer on the 15th of june.

Read my message above, but I believe this is regulated by Louisiana law. Leases have to comply with that law. They can't force you to give a 60 day notice if that's not what the law states. I am 90% positive La law is 30 days. However to mandate a rent increase the landlord has to give a 60 day notice to the tenants. I always assumed this is to allow tenants the option to move.

Upon expiration of the written lease it became a month to month lease. So no you are not obligated to stay til July 31. Notice of termination needed to be given at least ten calendar days before the end of the month.

Just leave. He won't spend a dime pursuing any legal action. The pursuit will cost more than the value of what he can get legally.
