Drunk driver sues bar for getting him drunk.

Yep, it's called responsible alcohol management program and social host liability.

It's complete and utter bull shite but the bar should have cut him off. He shouldn't have driven drunk but they failed to deny service.

This happens more than you think. A good bartender buddy of mine had a lawsuit hanging over his head for about 5 years. I can't recall why, but the suit was retracted.

When I bartended, if someone was clearly drunk, they got cut off by me with a quickness. Also cut down on fighting.

It just amazes me that the guy can offer his drunk driving crash as evidence that he was too intoxicated, yet was not charged with driving while intoxicated.

Can the bar ask him to prove that he was drunk?

I would think that the fact that he wasn't charged with DUI could be suggested as proof that he wasn't drunk?

Ok. Then what's his case? I'm honestly trying to understand his basis for damages from the bar.

If he was served too much, and was documented as intoxicated at his crash, I would get the case. But the lack of DWI suggest the opposite, as you say. So how is the bar liable for any damage to him or his vehicle? Much less $1,000,000.
