divorce court question

If someone started seeing another person "after" they officially filed for divorce, can he/she be accused of being an adulterer? What would a judge think?

I would think not because at that point you are legally separated.

The law is blind to morality. As long as it doesn't occur after dark, and or over night in the same house as your children….the law doesn't care.

Nor do they care why you are there in the first place.


They simply gut the the higher income earner of the 2 parties getting the divorce.


All of the divorce laws were formulated in a different era and really don't apply today but you don't get elected / or appointed judge under the platform of divorce reform.

Adultery is OK after you get a legal separation. That happens before a divorce is filed.

OP says divorce has only been filed. He didn't mention anything about a court ordering a legal separation. Not sure what jurisdiction OP is in though. Maybe that changes things.

here in TN adultery has nothing to do with anything.

means nothing as far as divorce paperwork goes.

Here is more info

In louisiana
Man leaves and files for divorce
Starts seeing another woman after he has filed
Never brought woman around his kids
Wife is now claiming her husband after he has left and filed is having affair with another and she files a month later for divorce based on adultery with mentioned woman...

Tbh, my opinion is the wife is just mad I guess....

I dont see a judge granting the wife divorce on those grounds esp since the man filed first and a full month earlier...wife is a total control freak and pretty much cray cray...

As soon as you're legally separated(living apart), it's fine.

yes, but it doesn't matter unless the adulterer is seeking alimony.

States vary; judges' opinions vary. You may be correct legally, but the judge may not agree. Sure, you might appeal and eventually win, but only the lawyers win, as always.

I always thought adultery was only when someone cheated while together during marriage

When I went thru my divorce 7 Yrs ago my atty who is an assitant da said I can see who I want after filing as long.as I didnt have them over night with my kids home...so what is it?

Haha...opposite sex and its a friend of mine..I feel bad possibly.because I told him what my atty told me....he proceeded to not watch out

I went through this w/ my divorce. It is because you are still legally married until the judgment of divorce is signed.
