Chinese Overtime

Anyone ever heard of this BS, my company pulled this on a special project we all worked on. I have a fixed annual salary.
For example, if an employee is paid a salary of $500.00 per week on a fluctuating workweek basis and works 45 hours one week, their overtime pay is calculated as follows:
$500/45 hours = $11.11 regular rate. Since their salary covers all hours worked at straight time, they are due half-time pay for hours worked over 40: $11.11 / 2 = $5.56 x 5 hours = $27.78.

You're on salary and you're getting paid overtime. Albeit reduced. Be happy that you're getting some extra compensation.

This is just the company being generous. If you are working under professional exemption, you don't qualify for overtime.

Where I used to work salaried got $5hr from 40-45 hrs, $4 hr from 46-50 hrs, $3 HR from 51-55 hrs, 2$ HR from 56-70 hrs, and anything over $70 they got $1 HR.
If you worked 10 hrs OT you got you regular pay plus

Actually this is a legitimate way to pay overtime. It can only be used for salaried individuals with fluctuating schedules though. It takes into consideration the weeks you work less than 40 hours and still get paid your normal pay for the week.

My last job I got paid my regular rate of pay for all OT I work even though I was salaried.
It was nice to get 40 hrs regular pay and 44 hrs at $24.83/hr during the winter months Jan-may.

The department of labor will say that's BS & recompute you to $500/40 hours = $12.50/HR straight pay.
Then OT rate is $12.50 + $6.25 = $18.75 X 5 hour = $93.75 OT.
$593.75 Gross pay due

be counted lucky you get paid any form of overtime
i'm salary, so on a week i turn in 40 hrs i get $36.058/hr one week i had a billable charge for another 2 hrs, so i turned in 42 hrs, and my rate went to $34.341/hr
both showing my weekly take home the same

In California, even if you are salaried, OT (1.5x) is anything over 8 hours a day.
