ATL Airport denied how I identify

I always opt out of the full body scan at the airport(see Bill of Rights), then they give you a little pat down and you're on your way. Usually no slower than everyone else I'm with. TSA rules state that it has to be someone of the same gender who pays you down. Well, at the ATL airport yesterday there was no male to pat me down so I told them I was a female and I could get a pat down by the lady I was talking to there. They denied my new identification.

Congratulations now you're on TSA's cavity search list for in the future. If you thought you were a little butthurt before...well you know. Make sure you get a good look at the TSA agent's knuckles beforehand.

What in the Bill of Rights makes the pat down search ok but not the body scan?
