Kidding aside, I would say "no offense" because people tend to give a pause after what they say and "no offense." Which to me is a giveaway that they thought they were tough enough to say something insulting, then got uncomfortable so they followed it up with "no offense."

If you're going to insult me, I probably had it coming. But don't be a bitch about it and stand by what you said.

I disagree. If you're in court and disagreeing with a judge, you're better off starting your argument with "With all due respect..." than with "No offense...".
