This guy should be getting a medal not prosecution by the DA. I guess New Orleans Law and Order gets mad when citizens do their job for them.

What's the problem? Idiots shouldn't have been trying to steal his A/C for what... 60 bucks worth of copper? The pastor should be given a medal, not arrested.

Who steals copper from a church? Those lowlifes could've knocked on the door and the preacher probably would've given them anything he could to help them out.

He shot the dude in the back of the head as they were driving away. You might WANT to do it, but it's not legal. I can't believe it took eight months to charge him.

No jury would ever convict a pastor for lighting up two animals that were stripping copper out a church air conditioning unit.

Also, I love how the low life theif is suing the pastor for shooting him while he was theiving. 'Merica.

It's a big thing to steal A/C units from a Church as well.

Back in 2012 me and a guy from a local A/C company donated units (used but nice) to a church after the old ones were stolen. (then put cages around them) It's fricking sad. People will cause $3000 in damage for $25-30 worthy of scrap, if that.

Copper thieves and graffiti "artists" need to start being shot.

Why is the officer just holding that gun? I've watched a lot of SVU, and you are supposed to use a knife to pick things up. Of course I guess it not like their trying to figure out who shot who.

I think we need a new law, I'll call it the "Hands Up Don't Shoot Law". I base it on this, in wartime it is perfectly legal to fire on a retreating or routed enemy, the assumption being that if they are not destroyed or neutralized, they will be able to regroup and continue fighting

Any criminal fleeing a crime where they have commissioned an act of violence or against property should be fair game for lethal force by law enforcement and citizens unless they are attempting to surrender.

Looking forward to any amendments or suggestions for this idea.

This exact scenario was covered in a USSC opinion in 1985.

Tennessee v. Garner, 471 U.S. 1 (1985)[1], was a case in which the Supreme Court of the United States held that, under the Fourth Amendment, when a law enforcement officer is pursuing a fleeing suspect, he or she may not use deadly force to prevent escape unless "the officer has probable cause to believe that the suspect poses a significant threat of death or serious physical injury to the officer or others."
