It has been rumored for a while, but didn't start getting out publicly until the wife filed for divorce.
I had never heard who it was, but did hear the rumor that he had a mistress over a year ago. I laughed it off for obvious reasons.

There's nothing illegal about having am affair. But of course a bunch of opportunists are going to try and politicize this, it's disgusting.

There is when he's using taxpayer funds to do it- Giving his mistress and her husband state jobs, using state troopers to facilitate it, using the state plane, etc.
