Having under a 0.08 BAC doesn't automatically mean you don't get a DUI.

Right. frick all the money and headaches. Hell 08 or not I deserve that much for driving on 3 hrs of sleep after drinking all night. Off my record is what I'd like if it is incorrect.

you can be convicted of DWI/DUI for driving fatigued

Dude, if it was your 1st and only dui you could have gotten deferred prosecution and it would be off your record.

Most municipalities offer defferred prosecution for 1st time offenders. Basically, a free pass.

SPEEDY would have reduced that to an inspection sticker and seat belt violation if paid in cash on the spot.

I feel like the camera showing my roadside test would go a long way if those blood results did not say what was presented in court. This isn't just the bac test. You may be right. That may make it all irrelevant

Yea a lot of this will depend on whether he just plead guilty or not. If you knowingly and voluntarily plead guilty, you might have a hard time fighting this over bac results.

Plus, pretty sure most police departments erase their dash cams after 3 or 4 weeks if no discovery is asked. And there is no guarantee the dash cam was even on.

Yes. I know I'm an idiot. I felt lie I didnt deserve to fight drunk driving. I just wanna see the results.
