Gesture is as good as words. There's a clear, threatening gesture here. This is so obvious.

A noose around a neck is a threatening gesture. Anytime people do this stuff should be a crime.

No. It's just silly. I don't think one should get thrown in jail, or face criminal repercussions, merely for being an a-hole. Apparently neither does the guy I was responding to. Not sure why he manned the post he did. Lampooning the OT like that, for the sake of, isn't original or funny.
