3 or 4 guys beating a guy with gun and they stop and the guy still has the gun and is not incapacitated. Makes no sense.

Cardell is totally fricked if he got out of the car with the gun in his hand, which is different info from what we've heard before.
i have 100% confidence that Smith was going back to his car to get his gun and was reaching for it when he was shot, which may have been what caused Hayes to shoot, but if he got out of his car with the gun then he escalated the situation from the beginning.

I don't think they were really beating on him either. I also read on Twitter that Will Smith charged him. I'm still trying to piece together the timeline between the alleged physical altercation and when exactly Smith went for his gun

One thing that is interesting is that Hayes repeated the night of the incident is "they were on something, i dont know what they drink or took, they were on something"
The fact he is saying that the night of, and Smith being a .240, gives him some credence that Smith and whoever else may have been acting belligerent.

After hearing this, I am posting my GUESS on what happend:

Hayes rear ends Smith. Smith and company exit car. They are drunk as shite as we know now. Smith and the shirtless wonder are angry. Smith is a pretty agressive guy. Hayes sees all of this. Hayes gets out with his gun like a dumbass with swagger never planning on using it. Just thinking he will be the man and scare these dudes who are trying to intimidate him. Smith goes, "oh yeh I got a gun too."
At this point, Hayes is in a tough spot. He is the dumbass that brought his gun out first. But, he sees a drunk Smith reaching in his glovebox and bang bang bang the rest is history.
I see it as alot of bad decisions by both parties and a manslaughter charge

If he was planning on using it he shoots smith dead to start. He doesnt let him get back to his car. Hayes was trying to be a tough guy

you don't get to show up with a gun and retaliate with someone who then feels the need to retrieve their gun due to you having your gun. That doesn't authorize you to shoot to kill in self defense.

The only thing factual and confirmed is will smith's bac. nothing else, hell nobody even confirmed a shirtless man story today. You, the one who rode the high horse on my assumptions, are making assumptions yourself.
