I'm not gonna get into the issue of whether Kaep should or shouldn't be in the league, but pursuing a collusion claim means one specific thing. He'd have to prove the owners actively worked together in coming to a collective decision not to play him. That's gonna be damn near impossible to do.
It's not as simple as comparing Kaep's skills to the 10-15 worst starters in the league and think it's a direct comparison. As an unbiased observer, it is entirely feasible that each of those 10 or so teams that would see Kaep's skills on the field as an upgrade over their current QB situations, could absolutely independently each make the decision that the negative attention he brings with him is not worth the marginal or slightly more than marginal upgrade he might bring at QB.
Regardless of how you feel about Kaep as a person or his stated opinions or his chosen methods of expressing those opinions, it is clear that any team considering taking him has to weigh it against the reaction of fans, sponsors, or just opportunists looking to capitalize on the hot topic all swirling around a team that just wants to win games. Would a marginal upgrade at QB from bad to slightly below average really be worth it? It's not hard to believe every team in such a place just looked at the situation and said "no thanks."

This is merely a PR stunt at this point. He has come to the realization that no one is going to sign him and his platform is gone. This is just another opportunity to get his name in the news before he ultimately fades into obscurity.

He better have some stone cold facts if he is going to win. He's accusing the NFL of collusion. Stats alone don't prove that.

They're not going to selectively ignore the other stuff he's said and done like opt out of his contract, make pro-Castro comments, and anti-police comments. If this was just about kneeling he'd probably have a shot. But the pro-Castro comments alone let at least 2-3 teams off the hook of not picking him up based on the Cuban populations in their cities alone.

I agree Kaep is not being given a chance because of the media attention he'd bring. However, that is not really collusion if every individual team feels that way without external pressure. The level of threshold for collusion is high and that will never be proven.

Flacco sucks, but even if kaepernick is marginally better, he also comes with a ton of negative publicity and would be a PR nightmare. So, it’s better to have a guy that throws for 5 yards/attempt while under the radar than a guy that throws for 7y/a while bringing a circus to town.

Yeah i get it a black guy isn’t getting his way so now people need to make an excuse for him. It isn’t “black balled” just bc they all have the same idea. Being blackballed and having all of the owners individually come to the conclusion he's not good enough for the baggage is two completely different things.

You're just being ridiculous. He doesn't have a job because he's a cancer. It doesn't take collusion for every owner to decide they don't want to fool with the Kaepernick drama. All that takes is common sense.
You know what really didn't help his case? All of his "brothers" kneeling, causing viewers to turn the TV off and actively choosing to NOT WATCH THE NFL. Why would anyone sign Kaepernick knowing what it's going to do to the bottomline and their public image?

If he wins this case it will not be bc of any of the reasons you mentioned in OP. TD to INT ratio would be hilarious if mentioned in court.
