Well if the NFL can prove that Brady destroyed his cell phone and obstructed the investigation they will win easily. Unlike the bounty situation obstructing an NFL investigation and the penalities are in the CBA. If the NFL can't prove it or Brady and NFLPA can cast enough doubt then Brady will win easil. So basicallly lawyers are about to get paid.
Just one of the many legal and nonlegal opinions on the matter

i love when people make this argument. brady compromised the integrity of the league and was complicit in cheating at his job. domestic abuse, while a serious offense, is a non-work related offense. people who chose to say that the length of the suspension is the nfl saying which act is worse to commit as a human being are highly ignorant.

I know a lot of people destroy their hard drives on a computer. I'm an OT poor who keeps his phones around in case I ever need them again

Even if he did destroy his phone (which is mighty suspicious), this still doesn't jive with NFL precedent. Brett Favre refused to hand over his phone during an NFL investigation and all he got was a fine.
