I know everyone remembers this story from a few years ago. Cory Baty was convicted of aggravated rape last night. Sentencing is on May 20. Aggravated rape in Tennessee is a mandatory 15-25 years. Baty has a 15 month old baby

Not familiar with the case, but if this is true:
Then she shouldn't be able to say this:
quote:
She does not remember what happened in Vandenburg’s dorm.
Then she shouldn't be able to say this:
quote:
The prosecutor's final question for the woman was: "Did you consent to any of that?"
"Absolutely not," the woman said, hanging her head and wiping her tears with a tissue.

Jaborian "Tip" McKenzie testified in the third day ofCory Batey's trial on aggravated rape and aggravated sexual battery charges in Nashville. McKenzie said he was with his teammates Batey, Brandon Vandenburg and Brandon
quote:
McKenzie said Batey appeared to be having sex with the woman in the dorm, stuck his penis in her mouth and sat on her face and raised his middle finger. He said Batey stuck his fingers into the woman and urinated on her. Jurors on Wednesday also watched three videos of parts of the incident, which were recovered by Metro police detective Chad Gishduring his investigation.
I'm guessing she was saying she would not have consented to that.

Dude totally ruined this girl's life. Videotaped it. She was in no position to consent, and he knew it. Dude deserves to get the same done to him in prison. Also, what chick has a kid with a guy that is on trial with a high probability of going to jail?

WTFdude?! Did you not read the article??

Allowed was a poor choice. I'll just say that she shouldn't have said that.

Your entire thought process was poor. You appear to be saying that these guys shouldn't be guilty. Dragged a passed out woman to a bed and did horrific things. This guy is a monster that should be in jail.

I don't know what was on the video or in the pictures. That's why I prefaced my post saying that.
The video and the pictures may very well be inconclusive as to whether she gave consent.
But,the guys probably were joking on the recording that she was knocked out. In that case, welp.

The article said she appeared to be unconscious. The article said she didn't remember, and then she said she "absolutely" did not consent to that.
It's possible to commit acts yet not remember them.
Again, I don't know what's on the pictures. I'm pretty sure they are terrible. From what I have learned in past experiences, the lighting is usually horrible, the pictures are angled, the room is dark, etc. It's hard to tell anything in lots of them.
They probably got it right. The facts are probably good for it.

That's answering a different question, though.

Or blacked out drunk.

Then why are guys being convicted of rape when they are blacked out drunk too? Why aren't they considered raped?

You also can't make absolute statements about things you can't remember. I'm pretty sure that is all Sabi is saying.
Doesn't mean the defendant isn't still guilty though.

Yeah, I think that is pretty evident from my first post.
I'm not saying the convictions aren't well deserved. The pictures and video probably indicate she wasn't conscious. I only said that lots of times (not necessarily in this case because I don't know the contents of the videos/pictures) pics and video can be pretty inconclusive.

I guess we can count Vandy's push to be more thuggish to run with the SEC as a failure.
and who was the head coach at Vandy then?
and where is he a head coach now?
I guess they brought him in to help their image.

If this had happened at Tenn, kid would still be on team, and his team mates would of beat her up.
