Via the Associated Press, Blue Earth County District Judge Krista Jass dismissed the child porn charges against Hoffner on Friday. ”The videos under consideration here contain nude images of Defendant’s minor children dancing and acting playful after a bath. That is all they contain,” Jass said in her ruling.

Hoffner was arrested in August on felony counts of using minors in a sexual performance or pornographic work and possessing child pornography. He had pleaded not guilty to those charges. An investigation began after a university official reportedly went to authorities with information on videos of children on Hoffner’s work-issued cellphone. Those children turned out to be Hoffner’s and no other related pornography was found on Hoffner’s computer.

If on his cell, how did anyone see it? Or was it monitored being work issued?

fricked up that people will think of this for the rest of his life. Guilty until proven innocent. Then still guilty.

I'm not the type to throw lawsuits around but I think I'd definitely be taking somebody to court for that. His name was sullied because he had bathtime videos of his kids. Countless number of parents have done this. Sucks for Hoffner.

At an earlier hearing on his motion for dismissal, Hoffner testified he had told his children to go take a bubble bath last June so he could get some work done. Hoffner said the children later came down in towels and asked him to videotape them. He said he never directed the kids, and never watched the video afterward or showed it to anyone.

The videos came to light after Hoffner took his problematic cellphone to work to be checked out.

The coach was escorted off the football practice field on Aug. 17 by university officials after the school turned the videos over to police, and he was arrested four days later.

They're just now figuring this out? Dang, how long does it take to show them pictures of his kids and compare them to videos.

The school owns the cell phone. It needed servicing so he turned it in to the school. A school employee saw the videos on it and the kids were naked. The school called the authorities and turned the phone over to police. One of his kids was flicking his pecker and laughing, etc. No porn intended, nothing on computers, etc. Hoffner is a good guy and very clean!

Cops and DA lied.

quote:

In her ruling dismissing the charges, District Court Judge Krista Jass said Hoffner can only be heard saying, “Wow. Are you guys done,” and, “Is the show over.” “At no time during either video does (Hoffner) direct the children’s actions; in fact, all of (Hoffner’s) statements on the videos are of a passive and inquisitorial nature,” Jass said in a memorandum explaining her order. “The camera never zooms in on any child or any area of any child. The focus of the videos is the children, generally, and not their genitalia. The children appear happy and playful in both videos.” Fleming also said Assistant Blue Earth County Attorney Mike Hanson allowed the videos to be taken out of context as the case progressed. He pointed out that Hanson used a well-known legal quote that U.S. Supreme Court Justice Potter Stewart used in a 1964 decision about obscenity. Whether or not Hoffner’s videos were illegal depended, in part, on them being obscene or lewd.
