Can I deduct a loss on a stock sale to my brother in law on my taxes?

Assuming that he and your sister file their taxes jointly, no. Pretty sure. One of the experts may wish to correct when their around.



He would be entitled to claim losses and gains that exceed your disallowed loss.

Don't see why you wouldn't sell stock then gift it to him.
