Need a will

Wife and I need to make out a simple will. Nothing very complicated. 2 kids split evenly. House, 401k's, some savings and a few other things. Don't feel like spending 500 on an attorney.

What state? If Louisiana, you can write it yourself. Make sure it is entirely handwritten, signed and dated. If more than one page, sign and date each page and number then 1of_, 2of etc.

Spend it on a lawyer. Probably one the best $500 you will spend on your children.

My grandparents had a will drawn up for their assets(a small farm in Franklin parish) for their two children(my Dad and my Uncle).

My Uncle & his wife got into a messy divorce, long story short, he lost everything.

Dad's inheritance is safe and was not touched.

IDK if she could have gotten to any of my dads half but you never know.

I have seen bothers and sisters become bitter, hated enemies over a few thousand dollars.

Don't let this happen to your children.

Get a lawyer to draw it up even though it is just a few assets.

does a simple will like that still go through probate? If so that could be pricey, I think a trust may be better for you. I admittedly dont understand wills that much but the attorney I used had me makes trusts bc he said wills are costly for the people who inherit bc of probate. Maybe he was doing it to scare me, I dont really know.

I get that you're cheap but the only olographic wills (the handwritten ones) I've ever come across that were done correctly were lawyers writing their own.

If you don't want to spend $500 call around. Not like there aren't 300 lawyers in the phone book, you should be able to find a young attorney to do one for $350 or so. Prices aren't set in stone: if someone quotes you $500 counter offer them. Any decent solo practitioner should have a template and a questionnaire that reduces the whole thing to an hour of work for them.

Yeah, OP don't take this as soliciting because it's not, but we don't charge $500 for wills.

Something easy like you're talking about should run you about $300 for both.

And depending on how old your kids are, you may not need a will at all to accomplish what you're talking about (50/50 split)

Then, most certainly go to a lawyer, and only update it through him. One of my friend's mom passed away 2 months ago and we found 3 wills. 1 was hand written a long time ago, and the other 2 were done through 2 different lawyers. It's a damn mess. Luckily, the kids are all cool with each other, but her brother is being kind of dick about a few things. Just get a lawyer and save your kids some trouble.

Last, when you get older, never sign papers with 1 kid without the other there. I've heard stories even on this site about 1 kid getting a parent to sign everything over to them. The parent was old and didn't understand what they were signing.

Louisiana has default rules for how property devolves down when someone dies without a will, but you probably want to have a will drawn up for peace of mind.

You should call around until you find someone to do it for $300-$400. It'll be worth it to your kids when you're gone.

You really should talk to an attorney. These days, it is much easier to set everything up via a trust. In the event your kids do something dumb later in life (get into massive debt, marry a terrible spouse, etc.) their inheritance can be protected from ex-spouses and creditors.

i got countless downvotes for suggesting that chongo. I was dealing with the same thing, I had a will and then the attorney I use laid it all out for me that my heirs would be paying a ton in senseless probate so we set up trusts
