Reccomendation he get a sub metering company to come out and look at installing individual meters.

Here is what I would ask for:

1) Refund of the additional amount charged to you in error

2) Confirmation that this problem will be resolved moving forward, including sending you and all other tenets a monthly calculation of the amount due

3) Full payment of any fees/costs you have for this issue.

I'm stunned the landlord, knowing full well he was wrong, lawyered up so quickly.

Correct future billing? Domination of said LL. My Lease states that I am responsible for utilities in connection with my use as a residential tenant. Paying for retail utilities is not in connection with my use.

Also minimal. I've kept a log of my hours and I will miss work for my hearing July 6. I'm not overly concerned with any of that though. Figure I don't need a lawyer at this point.

The attorney has been involved the entire time. I've asked them to fix the bills in every email and explained how these charges are normally applied in commercial/residential properties. No dice.

I've got eight months left on my Lease and have no desire to move as I have a super OT baller pad.

The building's monthly w/s/t bill is in the $4k range of which residential folks are paying all. I assume the LL doesn't want to fix the problem because they are probably either making a profit if they collect a monthly operating expense from retail tenants or dumb as shite.
