Cashing a check with 2 names

Here is my issues. My wife was involved in a wreck a few weeks ago. Car was totaled and we just received a check for the car. Problem is a few years ago I needed a 3rd vehicle and my dad had to co-sign for the car. I now have a check made out to him and I, second problem is he passed away in November.

Am I screwed on getting this check cashed or deposited? He didn't have a will and we don't have plans to do a succession. HELP!

Just do the succession or take your dad's death certificate when you go deposit the check.

You are going to end up needing to do a succession, but I know what I would do to cash this check, I am just not going to say it on here

I believe that he will need to sign the check over to you. Once he does that, then you can deposit the check into your account.

That's all I'm going to say here.

My grandma always writes my wife and I a check. Pain the arse to have to bring two IDs up there.

I think what these other folks are trying to say is SIGN HIS NAME ON THE CHECK.

Not what I wanted to do but maybe what I need to do. Not going through a succession for one check

Depositing the check via mobile banking or through ATM is same as taking it in the bank. Sign his name, sign yours, deposit in your account and be done with it. Should be simple as that.

This might sound crazy, but why not call the bank and ask for guidance on how to deposit the check?

Definitely don't sign his name on the check if you're planning to make a deposit in person. If they're following policy then they'll generally require the other individual to be present to verify the endorsement if they aren't on the deposit account.

So no it isn't as simple as to making it out just to me, the insurance company wont do that, already tried.

I've asked my bank what I should do and it seems none of them wanna make a decision because they are scared someone will wanna come back later and try and claim money.

It seems like the best thing to do it sign for him, mobile deposit it and be done. Could there be repercussion for signing his name and trying to deposit it this way? Do they look at the checks that hard when they are mobile deposited?

I doubt that a human will look at the endorsement unless it's a particularly large check. The bank is being cautious because if the check is endorsed by both payees as required, it will be a forged signature, and if at any point anyone questions the check, it can be returned for invalid endorsement for up to 3 years.
