Body shop endorse my name.

Hey guys I have a question. My wife was in a auto accident recently. She's ok and we set up to have the vehicle repaired. The shop repaired the vehicle and they were sent a check by my insurance company made out to them and myself. I never signed a power of attorney or endorse the check. I found out today that the shop signed my name and deposited the check.
I guess I'm trying find out what my next steps should be with this issue or should I take any steps at all. Yes I'm sure nothing was signed to give them authorization to endorse the check. They are aware of the situation and tried to resolve it today.

the check was made out to them as well as you so that they would lift the mechanic's lien from your car.

It's their money, why would you make them wait a day for you to go up there and sign it? They have to pay their employees.

You know I was thinking the same thing. The repairs look good and they were paid the exact amount of the estimate written. I guess it is hurt feelings do to the fact they were aware of the error two days ago and expected me to sign the power of attorney today.
Anyway I'll probably just see if they are willing to waive the deductible and move on.

Has this happened to you before? I know with State Farm that if you use one of their approved body shops that they will pay them directly and you just pay the body shop the deductible. That's happened to me twice and I have no issue with it.
Plus you don't have to arrange for a claims adjuster to see the car. I tell the insurance company who I plant to use, if it's on their list, I just go to the body shop, they give me an estimate and give it directly to the insurance company.
I'm thinking maybe this is a similar deal. I did know about this ahead of time though, so I can see why you might be a little upset.

So now you want something from the body shop? They did the repairs correctly (according to you) and at the price that was estimated. Get over it and move on. You aren't entitled to a discount because your "feelings were hurt".

Ok. So i guess it's ok for anybody to sign someone name to a check without their consent as long as they do not take anything. So we all could just try it and if we are caught then cool i didnt actually take anything so no harm no foul.
They sign my name before the repairs were even completed and then they tried to have me sign a poa after the fact without even notifying me of the error that was made.
I would have been ok if they told me about the mistake and offered to do something to rectify the matter. I'm not trying to get something for nothing. I'm feeling the way any consumer would feel. No different than when you argue with your cable company about serive and they offer free HBO.

So it's okay if i sign your name to a bunch of checks and spread them out among the city. You will be okay with that as long as nobody use the checks and I say I'm sorry.

They were named on the check. The money was designated for them for the repairs, NOT FOR YOU. Your signature was only required to verify the fact that the work was done. It was and to your satisfaction by your own admission.

It's a mistake. Probably one that they don't usually make. Maybe ask for an oil change or some new wipers.

That's the problem. My name was signed before the work was done and it was not sign by me.
The bottom line is you cannot just go around signing people's name to checks. You cannot go around signing another's persons name to anything for that matter without something to support that you represent that individual in some fashion.
That's why I used that horrible example. It does not matter if it's a bunch of checks like my example or one check. You do not suppose to do it.

The issue was resolved. They completed some touch ups on some dings that were not related to the loss and they waived the full deductible. I still do not have to sign the POA or a release for the deductible waiver. I'm satisfied.
