Not quite. HIPAA is a federal law that applies in very narrow circumstances to a very narrow category of persons/organizations. Just because HIPAA doesn't cover it doesn't mean it's not covered by other laws.
Every state has its own iteration of an invasion of privacy tort claim that would easily apply to cover the unauthorized dissemination of personal medical records, even if HIPAA doesn't cover it on the federal level.

But it wasn't hospital speak. It was pre-hospital, emergency setting speak, and unresponsive is used quite often in that setting. Everything from a pass out, to a stroke, to sleeping or too drunk to answer a question comes in as "unresponsive".

HIPAA is Federal law which only applies to "covered entities". You should probably research what parties actually fall under "covered entities" section of HIPAA. There are typically other privacy laws which could apply on a state level that cover non covered entities of HIPAA regulations.
Now all that said -- you may be right about HIPPA. I'm not really familiar with the HIPPA regulations. Is that the law where all doctors have to wear tight black jeans during their off hours?

It is the hospital's responsibility to keep that information private. Have you ever tried walking into a hospital in regular clothes and started taking pictures? It's forbidden.

So if, for instance, someone overhears a diagnosis of a person in an adjacent bed that has a curtain partition instead of a wall, it is not a violation as long as reasonable measures are taken to protect the privacy of the individual.

I always love when these threads turn into HIPAA debates. I think most of us come in these threads for possible status updates, not an internet doctor/lawyer's uninformed opinion on whether or not a HIPAA violation occurred. Who the frick cares?
