ETA: Looked it up, HIPAA does not apply to news organizations.

You don't know what your talking about. Stop talking.

I thought of an example. ... if Adam Schefter walked into an emergency room and took a picture of "pick a player" having surgery and posted it online or on TV, are you saying he is immune to recourse?

Looking forward to a reply with explanation

how, so if I go to the hospital and get diagnosed with cancer and a journalist is with me in the room he can leak it to CNN?

Yeah pretty much

Not quite. HIPAA is a federal law that applies in very narrow circumstances to a very narrow category of persons/organizations. Just because HIPAA doesn't cover it doesn't mean it's not covered by other laws.

Every state has its own iteration of an invasion of privacy tort claim that would easily apply to cover the unauthorized dissemination of personal medical records, even if HIPAA doesn't cover it on the federal level.

hopefully just passed out, but I don't like the unresponsive word, those are scary in Hospital speak.

But it wasn't hospital speak. It was pre-hospital, emergency setting speak, and unresponsive is used quite often in that setting. Everything from a pass out, to a stroke, to sleeping or too drunk to answer a question comes in as "unresponsive".

Yeah it's a HIPPA violation which fines all participating parties equally (leak source, news reporter, news station, etc). Bs HIPPA fines went up to $50k base per violation each person involved.

I'm sure someone else has pointed this out... but if not, just to be clear -- you are completely wrong.

HIPAA is Federal law which only applies to "covered entities". You should probably research what parties actually fall under "covered entities" section of HIPAA. There are typically other privacy laws which could apply on a state level that cover non covered entities of HIPAA regulations.

Now all that said -- you may be right about HIPPA. I'm not really familiar with the HIPPA regulations. Is that the law where all doctors have to wear tight black jeans during their off hours?

An IV drip of glucose can cure about anything that is not broke, torn, clogged, or serious. Good for Derrius.

Yes.

It's the provider's responsibility, not that douchebag Schefter's.

It is the hospital's responsibility to keep that information private. Have you ever tried walking into a hospital in regular clothes and started taking pictures? It's forbidden.
HIPAA applies to the health providers and record holders, not the general public.
So if, for instance, someone overhears a diagnosis of a person in an adjacent bed that has a curtain partition instead of a wall, it is not a violation as long as reasonable measures are taken to protect the privacy of the individual.

I always love when these threads turn into HIPAA debates. I think most of us come in these threads for possible status updates, not an internet doctor/lawyer's uninformed opinion on whether or not a HIPAA violation occurred. Who the frick cares?
