son...now looka heyah, what we're gonna do is put you in something we'll call "pretrial diversion".which sounds a lot like probation but, we're gonna give it this fancy name that doesn't have the stigma of probation.

Pretrial is different than probation kind of. Probation is generally a sentence for a crime. Pretrial delays prosecution during a probationary period.
If he does that his record is clean.
