Makers of NBA2K sued for using players' tattoos without permission

I'm sorry, but it should be on the player if they want their tattoos in the game or not. They already paid the tattoo artist for them, and most of theirs are custom to that athlete

So basically the tattoo artist are treating the tattoo's like software licensing. The athletes only pay for the right to have the tattoo put on their body, they don't actually own the IP. There is no way this holds up in court.
