Lindsey Graham: Kill US al-Qaida Operative Gadahn

"If captured, Gadahn should NOT be read his Miranda rights but held as an enemy combatant under the Law of War for intelligence gathering."

Then in a quick series of tweets, the senator elaborated:

"Even though Adam Gadahn is an American citizen, he should BE subject to being killed or captured by our military and intelligence forces," and "Adam Gadahn is an American citizen who has aligned himself with Al-Qaeda. He should be considered an enemy combatant, not a common criminal."

Graham’s twitter posts came a day after SITE, a Washington-based monitoring group, reported Gadahn recently appealed to wealthy Muslims to offer bounties to kill ambassadors in the region.

"These prizes have a great effect in instilling fear in the hearts of our cowardly enemies," Gadahn said in the 39-minute video posted on websites used by Islamist militants.


How about passing a law Lindsey?

I'm not saying this guy shouldn't be killed, but lets set some boundaries.

Lindsey Graham represents everything that is wrong with Washington. I hope he loses his primary.

Although not a big fan of his, I certainly agree with his stance on this. He should give it some clarity in a law like you've stated.

Maybe so.

But as as US citizen, he's no less entitled to a fair trial.

Lindsay Graham is a perfect example of how out of control our government is.

Let's just ignore that pesky Constitution. If he can be caught without violence then get him, and bring him to trial for treason. If he tries to fight back, then he can be killed on the spot as a combatant.

Regardless of what he has done, he still should get due process if possible.

Absolutely, there is no question about that.

Question, when is it okay for the government to kill a citizen without due process and when is it not? Should a President have unilateral discretion over who lives and dies? All I want is for them to do is give boundaries and process over who can be killed. There is no law granting the President the power to kill citizens is there?

true enough. but, he is absolutely right in his assessment of Gadahn.

So we should start to ask for passports and ID's before we kill Al Quaida members? What if we had we killed John Walker Lindh during a firefight? Would that have been an "unconstitutional execution?" I would prefer to catch this guy and bring him to trial, then hang him. However, he's chosen to side with the enemy; if he gets killed as a result then so be it. I despise Senator Graham as much as the next guy, but I agree 100% with the above statement.

No problem with this if he is actively fighting and is killed

This=drones and I have a problem with that. I don't think the extrajudicial killing of citizens (no matter what ideas/groups they align with) is appropriate. Try him for treason then sick the dogs on him but he should have his day in court (even if he's not there).

Are we a nation of laws or not?

Make a law that says US citizens proclaiming allegiance and taking arms with AQ or their associates will lose citizenship and will be considered an enemy of the US. Make laws that set the boundaries of who can be killed. Is this an extreme request? Make it legal and stop allowing the President to be the executioner without checks and balances.

I don't like this. If he's killed in a fire fight with troops or the police that is one thing. We should not be trying to gun down american citizens without due process though. If he is captured maranda rights should be read and he should be taken to jail. then the state can provide their open shut case they seem to have and then we can execute him. I'm totally ok with all of that but we don't want to allow the government to start killing US citizens if it can be avoided.
